Terms of Service

These Terms of Service ("Terms") are an agreement between you and How To, Boomer! ("we," "us") covering your use of howtoboomer.com and everything on it — the AI communication tools, the pickleball locations directory, the blog, and any accounts you create (together, the "Services"). By using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.

1. Who can use the Services

You must be at least 13 years old. If you're under 18, you may use the Services only with a parent or guardian's permission. The Services are not directed to children under 13.

2. What the Services are — and the AI behind them

The communication tools (Tone Breakdown, Tone Adjuster, Translator, Shame Detector, Response Generator) use artificial intelligence — currently large language models provided by third parties such as OpenAI — to analyze and generate text. Everything the tools tell you is machine-generated. You are interacting with software, not a person.

3. AI output — read this one

Output from the tools ("Output") is generated by AI and may be inaccurate, incomplete, or misleading. Output is an automated interpretation of text — it is not a factual determination of any real person's intent, tone, feelings, or character. The same input may produce different Output at different times, and similar Output may be generated for other users.

You agree to use your own judgment and not to rely on Output as your sole basis for any decision, communication, or action — especially decisions about your relationships. The tools are here to help you think, not to think for you. Your use of Output is at your own risk.

4. Not professional advice

The Services are provided for informational and entertainment purposes only. They do not provide — and are not a substitute for — medical, mental-health, therapeutic, legal, financial, or any other professional advice. If you need professional help, talk to a qualified professional.

5. Acceptable use

When using the Services, you agree not to:

  • Break any applicable law, or use the Services to harass, threaten, defame, or harm anyone.
  • Submit text or personal information you don't have the right to share — including other people's sensitive information submitted without their authority.
  • Scrape, bulk-download, or systematically extract the location directory or other content for redistribution. (Individual lookups are the point of the site — those are fine.)
  • Attempt to break, overload, probe, or reverse-engineer the Services, extract our prompts, or use the AI tools to generate content prohibited by these Terms or by our AI providers' usage policies, which also apply to your use.
  • Present Output as human-authored where the law requires AI-generated content to be disclosed, or use Output in high-stakes decisions (employment, credit, housing, medical, legal) without qualified human review.

We may suspend or terminate access for violations of this section.

6. Your content, our content

Your inputs. You own the text you submit to the tools. You give us a limited license to process it — and to send it to our AI providers — solely to run the analysis and provide the Services. We do not use your submitted text to train AI models.

Output. As between you and us, we assign to you all our right, title, and interest in the Output generated for you. Because it's AI-generated, Output may not be unique to you and may not be protectable by copyright.

Directory submissions. When you submit or correct a pickleball location (or post other public content), you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content as part of the Services. You represent that your submissions are accurate to your knowledge and that you have the right to share them. We reserve the right — but have no obligation — to review, edit, or remove user submissions.

Our content. The site's design, code, editorial content, and branding belong to us or our licensors. Don't reuse them commercially without permission.

Copyright complaints. If you believe content on the site infringes your copyright, email hello@howtoboomer.com with the material's location, your contact information, and a statement of good-faith belief, and we'll respond in accordance with the DMCA.

7. The pickleball directory

Directory information is community-contributed and changes constantly. Always confirm hours, fees, and access details with the location directly before driving across town. We're not responsible for out-of-date or inaccurate listings, wasted trips, or anything that happens at a listed location.

8. Accounts and termination

Accounts are optional. If you create one, keep your password secure — you're responsible for activity under your account. You can delete your account at any time. We may suspend or terminate accounts that violate these Terms, and we may modify or discontinue any part of the Services (it's a free service — we'll try to give notice, but we reserve the right). Sections 3, 4, and 9–12 survive termination.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT OUTPUT WILL BE ACCURATE, COMPLETE, OR RELIABLE. THE SERVICES ALSO DEPEND ON THIRD-PARTY AI PROVIDERS WE DO NOT CONTROL, AND WE ARE NOT RESPONSIBLE FOR THEIR AVAILABILITY OR CHANGES.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR RELATIONSHIPS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR ANY OUTPUT. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR ONE HUNDRED DOLLARS ($100). THESE LIMITS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, SUCH AS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold us harmless from third-party claims arising out of (a) content you submit to the Services — including text you had no right to share and directory submissions — or (b) your violation of these Terms, in each case except to the extent caused by our own misconduct.

12. Disputes: talk first, then arbitration

Informal resolution first. Before filing any claim, you agree to email hello@howtoboomer.com a written description of the dispute and give us 60 days to work it out with you in good faith. Most problems get solved this way. The same applies to claims we might bring against you.

Binding arbitration. If we can't resolve it informally, you and we agree that any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (including its Mass Arbitration Supplementary Rules), rather than in court. The Federal Arbitration Act governs this section. Judgment on the award may be entered in any court with jurisdiction.

Exceptions. Either party may instead bring an individual claim in small-claims court, or seek injunctive relief in court for intellectual-property infringement or unauthorized access to the Services.

Class-action waiver. DISPUTES WILL BE ARBITRATED ONLY ON AN INDIVIDUAL BASIS. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

Coordinated filings. If 25 or more similar claims are filed against us by the same or coordinated counsel, the parties agree the AAA's batching and staged ("bellwether") procedures will apply, and each claimant must personally verify their claim.

Your right to opt out. You may opt out of this arbitration agreement by emailing hello@howtoboomer.com within 30 days of first accepting these Terms, with your name and the email associated with your use. Opting out does not affect any other part of these Terms.

Severability ladder. If the class-action waiver is found unenforceable as to a particular claim, then this entire arbitration section (not the rest of these Terms) is void as to that claim, which shall proceed in court — and in no event shall any arbitration proceed on a class or representative basis.

13. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Section 12. If a claim proceeds in court, it must be brought in the state or federal courts located in Utah — except small-claims matters, which may be brought in your local small-claims court. Nothing in this section deprives you of protections of the consumer laws of the state where you live.

14. Changes to these Terms

We may update these Terms. If a change is material, we'll give at least 30 days' notice before it takes effect — by email to account holders, a notice on the site, or both — and we'll update the "Last updated" date above. Continued use after the effective date means you accept the updated Terms; if you don't agree, stop using the Services and delete your account. Changes are not retroactive to disputes that arose before the change.

15. Everything else

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary (or severed) and the rest remain in effect. Our not enforcing a provision isn't a waiver of it. These Terms plus the Privacy Policy are the entire agreement between you and us about the Services. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the Services.
